HandyScoot Warranty

At HandyScoot™, we are committed to ensuring the quality and performance of our mobility scooters. We stand behind our products and offer the following warranty coverage for your peace of mind:

Limited Warranty Coverage:

• 2 Year Limited Warranty: Our warranty covers the structural frame of your mobility scooter under normal use conditions for a period of 2 years from the date of the original retail purchase.

• 2 Year Limited Warranty: All components, including the motor, brakes, electrical system, and axles, are covered under this warranty for 2 years under normal use conditions.

• 2 Year Limited Warranty: Your scooter's battery is also covered for 2 years under normal use conditions.

Ownership and Transferability:

This limited warranty is exclusive to the original owner and is not transferable to any other party. If a defect arises, HandyScoot™ offers three options:

1. Provide components to repair the unit using new or refurbished parts at no cost.
2. Exchange the HandyScoot™ with a functionally equivalent product that is either new or refurbished.
3. Refund the original purchase price.

Exclusions:

Please note that this warranty does not cover damage caused by abuse, misuse, accidents, unauthorized repairs, alterations, modifications, or any causes that are not related to defects in materials and workmanship for which HandyScoot™ is responsible.

Additionally, normal wear and tear, including items such as tires, upholstery, fuses, and more, are not covered under this warranty.

Limitation of Liability:

To the extent permitted by applicable law, HandyScoot™ is not liable for any direct, indirect, incidental, or consequential damages arising from the use or service of the HandyScoot™. The warranty and remedies mentioned above are exclusive and replace all other warranties, remedies, or conditions, whether oral, written, express, statutory, or implied, to the extent permitted by applicable law.

HandyScoot™ specifically disclaims all implied and statutory warranties, including, without limitation, warranties of merchantability and fitness for a particular purpose. If implied warranties cannot be disclaimed, they are limited in duration to the duration of this warranty. Any recovery is limited to the original purchase price.

No person is authorized to modify this limited warranty.

Statutory Rights:

This warranty does not affect your statutory rights. Depending on your state, you may have additional rights beyond this warranty.

Governing Law and Jurisdiction:

All disputes, lawsuits, and claims, as well as this warranty, are governed by and interpreted under the laws of the State of New Mexico. The parties consent to the jurisdiction of the State Court of Santa Fe County, New Mexico, as the exclusive venue for any disputes, lawsuits, and claims.

The parties waive the right to a jury trial, the right to consolidate proceedings as a class action, or to have proceedings handled as a class action. All proceedings will be conducted solely on an individual basis. If any provision in this warranty is found to be illegal or unenforceable, the remaining provisions shall remain in full force and effect.
